The legal termination of pregnancy (ILE) was consolidated in an 11-year-old girl who was raped by her uncle in a rural community in the municipality of Betanzos. This means that the rape victim was subjected to a surgical abortion procedure in accordance with the regulations in force.
The medical action was performed in a health center of the Villa Imperial based on the provisions of the laws in force and Constitutional Ruling No. 0206, which eliminates the need for a court order to perform a legal termination of pregnancy in the case of minors who are victims of rape.
It is indicated that the ILE should be implemented upon a simple complaint from the Defensoría de la Niñez y Adolescencia or another entity that defends the rights of minors, and that parents do not need to authorize this procedure.
The Potosi Ombudsman Delegate, Jackeline Alarcon had indicated that the employees of institutions should understand that the mentioned sentence eliminated the judicial authorization to access a legal abortion when the pregnancy is the result of rape, statutory rape, incest or abduction; and also when the life or health of the woman is in danger as a consequence of the pregnancy.
In a previous statement he had already made it clear that in the case of the 11-year-old girl who was raped by her uncle in a community in the municipality of Betanzos, the legal termination of pregnancy should be applied.
“The institutions must be trained to see the girls as victims and not as child mothers, but as victims of a crime that is the worst that can happen to a child. Internationally, it is considered torture to force a girl or adolescent who was a victim of this crime to gestate and give birth,” said the representative of the Potosi Ombudsman’s Office.

It was learned that the authorities of the institutions involved in the case of the minor who became pregnant as a result of her uncle’s rape decided to declare the case confidential, since it involves a minor and respect for her rights must be guaranteed.
The measure comes after an incident in which some women activists arrived at the health center where the minor was and made known their rejection to the legal termination of pregnancy, which they compare to an ordinary abortion.
